copyright and facebook ADVICE AND HELP NEEDED PLEASE

A company i used for my recent holiday have annouced on there page they were going to include one of my photos into there upcomming competition. they have not as yet launched this competition or annouced terms and conditions with full details of the prize apart from saying it will be vouchers to use for a holiday with them. and i have not given them permission as yet to consider it for a prize.

i expect they are after images to sell there holidays in the future so how do i go about trying to sell them some of the images and what would be a reasonable amount to ask for.

me and sharon may not be top notch phoographers but i dont want my photos used and me being taken for a mug lol

it was taken on a public street with no people in the shot but you could make out the name of the hotel............it is not the hotel that is trying to use the photo but the company that send coach parties to that hotel

Facebook is a bit of a minefield Nigel and I am still waiting for Fred to allow an opt out of linking our photos from here on Facebook. I do not want my images on Facebook and although I don't mind Fuji using them if they want to I do object to them going on to FB.

I would suggest that you write to the firm and say that if they decide to use any of your images you will be expecting some sort of recompense. But I suspect Steve is right - they'll simply use someone else's.

Where ever you upload your Images some one somewhere will copy it and claim it as there own even here in the Competition Rules there is this bit 

  1. Please note that, in common with many websites, uploading your image to the MyFinePix website means that other parties can view and make a copy of the image. Fuji film does not accept responsibility for any theft or consequences of your images being used by third parties.

Dont you have the option of deleting your original picture posting?

You could then replace it with a ©Nigel Thomas emblazoned one

Hi

While millions of people are prepared to give away their images as they seek 'recognition' including many on this and other sites, you can never hope to get paid from those who use images without thought.

If you don't want them to be used, don't put them on open INTERNET sites.

It seems you only give facebook permission to use your pictures, not other people/companies. You might want to check out the sub-licensable part though. Find out who they license things to. I'd guess not the holiday company though. Ask them for £30 Smile

Unfortunately Chas is completely right .

No other way around it .

Only post your second best shots on the web , or at lower resolutions than your originals  ( fairly safe bet here then ) or stay at home Smile

I found that a Pub Company was using one of my pictures in a local pub,I asked the landlord where he got picture from,was told Head office supplied it so I Billed them.They paid in full the £100 I cheekily asked for,they said the picture came from an image Library the only place that picture has been posted was Flickr.By the way I would have settled for a meal and a couple of pints

Once I gave an image to a local university upon their request to use in some literature.  A month or so later they contracted me to do a photography assignment for them...they paid me VERY well and put me up in a nice hotel for several days and paid my travel and other expenses...I've done a total of 3 similar assignments for them.  So it can pay to give a photo away.

If they want your photo, consider yourself top notch.
